CBC Invites Traffic Ticket Guru To Respond To Photo Radar Decision
After Counsillor Gord Steeves denied that Winnipeg's Photo Enforcement program is a Cash Grab On February 10th while being Interviewed On CBC's information radio, Trafficticketguru.com was invited to come in the next morning to respond to this and The decision by Judicial Justice Norm Sundstrom who dismissed 9 Photo Radar Tickets issued for speeding in a Construction Zone when No Workers Were Present. Being interviewed by Terry MacLeod, Owner of Trafficticketguru.com Larry Stefanuik disputed Steeves Claim that the program and in particular Construction Zone Ticketing was not a cash grab.
The City of Winnipeg wants to enforce the reduced speed zone when workers are gone because they are concerned about the safety of Drivers not just the workers. Steeves used the example of The Bishop Grandin Bridge project and how vehicles were re routed onto one of the two bridge spans creating a two way traffic flow on what would normally be a one way 2 lane bridge. Steeves felt that if the vehicles were allowed to proceed at 80 kph with only 4 to 5 feet between them (Like on a normal Highway!) that if a vehicle hit one of the chevrons or pylons they could flip it up through a front windshield or send it Helicoptering into the pedestrian walkway right beside the driving part of the bridge. | In response to this Stefanuik stated, "How can you set up a system where you're not slowing the vehicle? All your doing is taking a picture of it as it passes by and goes through the construction zone, so you're not creating any safety because if you look at their numbers they are still generating lots of tickets at these locations. Are citizens supposed to be so naive to believe that the only way to slow vehicles down at a construction zone is to put a photo radar unit in there? Why not have manned police units in there? That will slow them down even more, or, why not just better barricade set ups? Barricades can be set up at the entrance to a construction zone that create the illusion of a very narrow passageway that causes a vehicle to slow right down. Then why not put temporary speed bumps in along the way to keep the vehicles at a maintained speed?" |
When asked if it was the whole program or the Construction zone issue that Stefanuik was against, he advised that it was about the system, because they are promoting it as a safety tool when really it is not. I mean if they are going to use it, call it what it is, it is a way of generating revenue. In fact Gord Steeves was quoted back on February 15 of 2007 after the City re-signed their contract with ACS and indicated that they had spent a lot of time over the last five years trying to spin this like their not about revenue but they certainly are revenue related. Stefanuik then went on to discuss the difference in speed tolerances between the cameras and police officers enforcing speed. There is no written policy that tells an officer at what speed they should ticket at. The Highway Traffic Act starts it's fine structure at 10kph over and although no one will confirm it, the cameras appear to be set at this threshold. When asked if the City should do away with the cameras Stefanuik replied that they should or admit it's about revenue and put it to a vote. He then suggested that if it's not about revenue then they should do like some jurisdictions in the USA and mandate the profits be donated to schools. Everywhere else this has been tried the Cities end up dropping their program! The conversation then turned to Red Light Cameras and Stefanuik explained how they are designed to work with minimum or shortened amber times to create a 'Dilemma Zone' that forces a driver (Doing the Speed Limit) depending on where they are when the amber light comes on to have to either;
- Speed up quickly to clear the intersection. Increasing the likelihood of hitting that 10 over threshold.
- Maintain the limit and enter the intersection during the 1st second of the Signal Change, an offence not visible to the human eye and statistically posing no danger due to the fact that all the lights are still red during that first second.
- Braking hard and chancing a rear end collision. (Which have increased in Winnipeg at Intersections with Red Light Cameras) This is confirmed in the City of Winnipeg's 2006 audit of the program which criticized the fact that collisions have increased. Several other reports have confirmed the same in other jurisdictions.
Stefanuik went on to explain that the City's Signal Depatment will not respond to emails asking for confirmation if that is the minimum time. The interview finished up with Stefanuik advising those who have been ticketed unfairly to hang on as this is going to be appealed and if the Crown loses then it is likely refunds will result.
